Plain-English terms for engaging DushiWeb — scope, payment, ownership, warranties, and how we handle disputes.

What this agreement covers
These terms apply when you engage DushiWeb to design, build, host, or maintain a website or software product. They are intentionally written in plain English — if anything is unclear, ask before signing off.
Any custom proposal, scope document, or quote we send you takes precedence over these terms where they conflict.
What's included in a build
Each tier (Starter, Professional, Custom) lists exactly what's built. We follow that scope. Out-of-scope additions are quoted separately before work starts.
We work in stages with check-ins. You see progress weekly. Revisions to in-scope deliverables are included until launch.
Payment terms
Build: 50% to start, 50% on launch. For larger projects (over ANG 8.000), we can split into 3 milestones.
Yearly care: invoiced annually in advance. Year 1 is included with the launch invoice; subsequent years invoiced 30 days before renewal.
Payment methods: bank transfer, Stripe (cards, Apple Pay, Google Pay), or in-person.
Late payment: invoices unpaid after 30 days incur a 2% monthly fee on the outstanding balance.
Ownership of code and content
You own the code, content, designs, and domain — fully. We hand over everything at launch and on request thereafter.
You can move hosting, change developers, or take the site offline at any time. No lock-in, no exit fees.
We retain the right to mention the project in our portfolio (anonymously if you prefer) and to reuse generic patterns we developed in future projects.
Third-party services
Builds rely on third-party services (Vercel hosting, Stripe payments, Resend email, Cal.com bookings, etc.). Their pricing, uptime, and policies apply alongside ours.
Yearly care includes our hosting (via Vercel's hobby/pro tier on our account or yours). If you outgrow our included tier we'll quote the upgrade transparently.
What we promise
Quality: the site will be functional, secure, and built to current web standards (Lighthouse 90+ at launch).
Timeline: we deliver within the agreed timeline or notify you of delays in advance.
Bugs at launch: any bugs we introduced and you report within 30 days of launch are fixed at no charge.
Maintenance: under a yearly care plan, security updates and routine maintenance are handled. Major changes (new features, redesigns) are quoted separately.
What we don't promise
We don't guarantee specific business outcomes (rankings, traffic, sales) — those depend on factors outside our control.
We don't provide legal, financial, or compliance advice. If your industry requires specific regulatory features, please tell us upfront.
Third-party service outages (Vercel, Stripe, Cal.com going down) are outside our control. We monitor and respond, but uptime is what those providers commit to.
Cancellation and refunds
Before kickoff: full refund minus any specific upfront costs (e.g. domain registration).
During build: you can cancel; you pay for work completed to date plus 25% of the remaining scope.
Yearly care: cancel at any time. We'll prorate the remaining months. If you've already paid the year, the unused portion is refunded.
We may decline to continue work in cases of abusive behaviour, illegal content requests, or non-payment after 60 days. Refunds in that case are at our discretion.
Liability limit
Our total liability under any project is capped at the total amount paid to us under that project in the 12 months prior to a claim.
We carry no liability for indirect or consequential damages (lost revenue, lost data, business interruption) arising from the use of work delivered.
Governing law
These terms are governed by the law of Curaçao. Disputes will first be raised in good faith between us; if unresolved within 30 days, they may be brought before the courts of Curaçao.
